PARIS – Opening statements are expected to be given Tuesday in the double murder trial of Duane C. Waterman, 33, of Sumner.
A jury of 10 men and six women were chosen Monday in Oxford County Superior Court.
Waterman is charged with shooting Timothy Mayberry, 50, of West Paris, and Todd Smith, 43, of Paris at Mayberry’s residence on Tuelltown Road in West Paris last July. Waterman has pleaded not guilty.
Assistant Attorney General Andrew Benson and defense attorney John Jenness Jr. of Paris agreed on the selection of jurors, who include four alternates.
Justice Roland Cole instructed them jury not to follow any media accounts of the trial or do any Internet searches related to the case. He estimated that the trial will take more than a week.
According to an affidavit by Detective Scott Gosselin of the Maine State Police, Waterman and his family had lived with Mayberry prior to the killings. He wrote that Waterman, his wife and three children were evicted and Mayberry accused Duane Waterman of owing him about $4,000.
According to a police affidavit, Waterman indicated that Mayberry supplied him and others with “Oxys” – Oxycontin pills. Waterman told police that he took the opiate for a back injury, but no longer had a prescription for it, so he bought the pills from local dealers.
Benson has said Waterman owned a gun consistent with shell casings found at Mayberry’s home, and that Mayberry had said before he was killed that he was afraid Waterman would attack him over the debt.
Waterman was arrested Aug. 4, 2008, while fishing with his children on Bretton Pond in Livermore.
If found guilty, Waterman could serve between 25 years and life in prison.
