PARIS — A father and son pleaded guilty Wednesday to charges that they assaulted a police officer during an altercation at their home.

Robert Clyde Foster, 45, and Robert Clarence Foster, 26, both of 47 Cygnet Drive in Denmark, pleaded guilty in Oxford County Superior Court to simple assault, a lesser charge than the original felony assault on an officer. The older Foster also pleaded guilty to refusing to submit to arrest.

Justice Donald Marden accepted a plea agreement that sentenced the older Foster to serve 90 days of a 364-day jail sentence with one year of probation and fines totaling $500. The younger Foster was ordered to serve 14 days of a six-month sentence with one year of probation and a $300 fine. During probation, both men must not use alcohol or illegal drugs, submit to random searches, and undergo substance-abuse evaluation and counseling.

According to a police report, Trooper Dan Hanson of the Maine State Police warned the men for disorderly conduct shortly after midnight on June 25 after responding to a dispute between the older Foster and his neighbor. Hanson said both Fosters were intoxicated, and he arrested the younger one after he shouted outside the house following the warning.

Hanson said that both men shoved and threatened him, and he was kicked in the chest. He also said the men tried to take his baton and the firearm of a responding officer, but complied with arrest after another responding officer drew a stun gun.

The plea dismissed charges of obstructing government administration, disorderly conduct and criminal threatening against both men, as well as a refusing-to-submit-to-arrest charge against the younger Foster. It also dismissed charges of cultivating marijuana and violation of conditions of release stemming from the discovery of a marijuana plant, drug paraphernalia and firearms in the house during a police search June 26.

“It’s easy to have a dispute with your neighbor, but you add alcohol to it and look where you end up,” Marden said.
