PORTLAND, Maine (AP) — Maine’s highest court has upheld the convictions and sentence of a 34-year-old man who’s serving a life sentence for a double murder that stemmed from a dispute over money and drugs.
In an unanimous ruling, the Maine Supreme Judicial Court on Tuesday upheld the convictions of Duane Waterman of Sumner, who was found guilty last June of fatally shooting 50-year-old Timothy Mayberry of West Paris and 43-year-old Todd Smith of Paris. The shooting took place at Mayberry’s home in July 2008.
In his appeal, Waterman argued there was insufficient evidence to convict him and that the court erred when it wouldn’t allow him to question witnesses on an alternative-suspect theory. He also argued that the judge abused his discretion in sentencing him to two life sentences.
