PARIS — A condominium association at Sunday River Ski Resort has filed suit against an Auburn precast manufacturing company, charging improper installation of a fresh water cistern.
Fall Line Condominium Association is charging Oldcastle Precast Inc. with breach of contract, misrepresentation, negligence and fraud. The suit was filed with the Oxford County Superior Court.
Fall Line’s complaint states that the association purchased a cistern from Oldcastle in August or September 2008. Neal Weinstein, representing Fall Line, said the cistern was delivered with cracks and pieces of concrete missing. He said the cistern was further damaged when the engineer and several other workers left for another job, resulting in further damage “because [Oldcastle] allowed the cistern to be unloaded and assembled by personnel insufficiently trained and skilled in its assembly.”
Weinstein said the damage led to leakage and bacteria contamination in the cistern, resulting in a boil water order. Roger Crouse, director of the Maine Center for Disease Control Drinking Water Program, said a boil water order was put into effect at Fall Line in October 2008 after a positive test for E. coli bacteria. The order was lifted in late January of 2009.
The suit says that the association bought a water monitoring and chlorination system and hired people to monitor it, and later replaced the cistern after determining that it would be cheaper to buy a new system than repair the old one.
It charges that the association suffered an estimated $100,000 loss due to extensive repairs and maintenance, the replacement of the cistern, loss of rental income and condominium use, and “loss of reputation.”
According to the Sunday River Real Estate website, the Fall Line Condominiums are located at the South Ridge at Sunday River and contain 128 one-bedroom units. Gringo Harry’s restaurant is also in the condominium building.
According to its website, Oldcastle is a national company with more than 80 locations and manufactures precast concrete, polymer concrete, and plastic products. The company had not filed a response to the lawsuit by Wednesday, and a representative was unavailable for comment.
