AUBURN — A man charged with attempted murder is seeking to have evidence against him and his statements thrown out before his trial next month.

Mark McLaughlin, 51, of Lewiston is being held without bail in Androscoggin County Jail.

He was indicted last month by an Androscoggin County grand jury on one count of attempted murder. He has lesser charges pending of aggravated assault and elevated aggravated assault.

A woman with whom he shared an apartment was stabbed in the chest and back and made her way to a nearby hospital in September.

Through his attorney, James Howaniec, McLaughlin filed a motion to suppress all evidence related to his arrest. That includes statements he made to police, their observations and “tangible evidence” they seized from him.

His detention and arrest were “without warrant and without probable cause” and were, therefore, illegal and in violation of his constitutional rights, McLaughlin said. Any evidence that resulted from his arrest also is illegal and unconstitutional, he said.

Any identification of him is illegal and a violation of his constitutional rights, Howaniec wrote in court documents.

McLaughlin didn’t receive his Miranda warning or voluntarily waive his right against self-incriminating statements and his right to legal representation, Howaniec wrote.
