AUBURN — A former Bates College student pleaded guilty Friday to a charge of resisting arrest in connection with a melee at the end of the school year last spring during which a Lewiston police officer broke his leg.

Roughly 300 students converged on Smith Hall the night of May 26. College security was overwhelmed and called in Lewiston police, who eventually broke up the crowd.

Andrew Livingston, 24, of Waterville agreed to plead guilty to the Class D misdemeanor. Two other charges were dropped. Livingston agreed to volunteer 50 hours of community service within the year. If he completes that service and steers clear of the law, he may withdraw his plea and the remaining charge will be dropped.

Livingston appeared in Androscoggin County Superior Court with lawyer Ilse Teeters-Trumpy.

Assistant District Attorney Andrew Matulis told Justice MaryGay Kennedy that the state agreed to drop the charge of failure to disperse because prosecutors lacked sufficient evidence to prove Livingston had been present and had heard warnings when police first told students to leave.

Matulis said the state also dropped the charge of obstructing a public way because, at the time Livingston was told to move out of the road, it had been shut down and he didn’t appear to be blocking traffic.

Prosecutors didn’t drop the charge of refusing to submit to arrest because Livingston used physical force to resist police in their efforts to handcuff him, Matulis said.

Teeters-Trumpy said her client agreed to plead guilty to that charge, but he didn’t agree with the state’s characterization of the events and Livingston’s role in them.

Justice Kennedy reminded Livingston that he could be convicted on the charge to which he pleaded if he were to violate the conditions of his release and deferred disposition. She scheduled a hearing for Dec. 7, 2011, for him to withdraw his plea.

Eleven students were arrested in connection with the midnight melee when seniors visited their first-year dorms on campus. Of those arrested, one other has pleaded guilty to charges. One is facing a bench trial in 8th District Court in Lewiston. The rest are expected to go to trial, some of them later this month.
