AUBURN — A judge gave a former Livermore Falls sewer clerk until April to catch up on her restitution payments to the town.
Faith Nichols, 40, was accused by prosecutors of failing to keep up on her payments for restitution and supervisory fees. At a recent hearing in Androscoggin County Superior Court on a motion by the state to revoke her probation, she denied the accusation and her case was continued for further payment and restitution, a court clerk said.
Nichols was jailed for embezzling more than $100,000 from the Livermore Falls Sewer District after she pleaded guilty in 2007 to theft by unauthorized taking or transfer, a felony. She was sentenced to six years in prison with all but two months suspended. She also was sentenced to four years probation.
According to court papers, Nichols has paid only $871 of $46,000 restitution ordered by the court. She also has failed to pay $15 per month for supervision fees to the Maine Department of Corrections and still owes $670, according to a motion filed with the court.
At the time of her plea, she had repaid about $56,000 of the $102,000 she was accused of taking from the town. The town had placed a lien on Nichols’ house, which was sold, and $31,843.26 of the proceeds were transferred to the town toward the reimbursement.
