AUGUSTA (AP) — The trial of a Massachusetts man charged with killing a Maine man who had taken him into his home has been moved to Franklin County from Kennebec County.

A judge Tuesday moved the trial of David Silva Jr. out of Kennebec County because noisy construction is scheduled to take place near the courthouse during the trial scheduled for February.

The Kennebec Journal reported that Silva, formerly of Carver, Mass., agreed.

The judge noted that Silva’s attorney had indicated he would seek a change of venue and prosecutors did not object.

Authorities allege the 34-year-old Silva fatally shot 53-year-old Robert Orr in his Readfield home in February 2011, then set the house ablaze.

Orr had rented a room in his home to Silva and his girlfriend weeks before the slaying.
