WILTON — An appeal of the Planning Board’s decision to grant a permit to reconstruct a dam on Dakin Stream will be heard when the Board of Appeals meets at 7 p.m. Thursday, July 25, at the town office.

In May, the Planning Board reviewed and approved a permit for Derrick Thibodeault of Parsonsfield for construction of a dam to create a pond.

There used to be a dam there but it washed out during Tropical Storm Irene and Thibodeault wanted to rebuild, putting in an earth dam, a water control structure, culvert and flash board to adjust water height, Paul Montague, code enforcement officer said.

The appeal, requested by Conrad Heeschen and Pam Prodan, questions whether the original dam was legally constructed. It also questions whether a non-conforming structure is being made more non-conforming, he said.

The proposed dam on Dakin Stream by Dakin Road is located off Tobin Flat Road, which is off Weld Road. The property is in the town’s Resource Protection and Farm and Forest Zone.

Heeschen’s property is located downstream of the proposed dam which could have an affect on their property, he said.

The project has been permitted by the state Department of Environmental Protection, Montague said.
