AUBURN — Two men, one a former high school track star, were in court Wednesday to answer charges in connection with an armed robbery of medical marijuana.

Kevin Stitchel, 22, of Portland and Ricardo Hairston, 19, of Lewiston pleaded not guilty in Androscoggin County Superior Court to several charges, including felony robbery, which is punishable by up to 30 years in prison.

A third defendant arrested in connection with the robbery, Derrick J. McDuffy, 20, of Portland pleaded not guilty to robbery and other charges Friday. He was held in Androscoggin County Jail in lieu of $30,000 cash bail. Stitchel and Hairston were held in jail in lieu of $20,000 cash bail.

Police said the three men reportedly kicked in the door of the first floor apartment of Scott Breton, 40, of 51 Pierce St. and his wife, Wanda, also 40, on Sept. 7 shortly before 9 a.m.

The three men allegedly fled into another apartment building in the area, police said in a affidavit.

One of the men aimed a sawed-off shotgun at Breton’s face through the partially-open door to his apartment, he told police. Another one of the men held a revolver, he said.

Breton’s wife fled into a back bedroom to call police on her cellphone, but was chased by one of the men and brought back and her cellphone confiscated.

Breton said the man with the shotgun said he would “shoot him in the face” and “kill him” if he didn’t get his medical marijuana and his wife’s wallet. When she told the men she didn’t have her wallet, they took her laptop computer, cellphone and iPod. They also took roughly one-and-a-quarter ounces of Breton’s marijuana that he kept in a tin in his kitchen and was licensed to have for medical purposes.

A police officer viewed a surveillance videotape from Poirier’s Market at the corner of Pierce and Walnut streets that showed the men running south on Pierce Street and into the driveway next to 21 Walnut St.

Police conducted a floor-by-floor search of the building and recovered a loaded sawed-off shotgun and a loaded .22-caliber Ruger pistol. They also found a black jacket, a cellphone, a red sweater, a gray hooded sweatshirt and iPod stuffed in a dryer on the first floor. Near the dryer was a backpack with a laptop inside. The items were damp. It had been raining.

One of the tenants told an officer that three men knocked on his apartment door and asked to come in. He said he let them in and they were still there. Police found the three men in the apartment. They handcuffed the trio and put them into police cruisers and took them to the police station.

Breton picked out Stitchel and Hairston from photo lineups. He wasn’t able to identify McDuffy, police said in the affidavit.

Police said McDuffy admitted breaking into Breton’s apartment to steal the marijuana. He said Stitchel had brought the guns in a backpack and had kept the handgun for himself. Hairston admitted he had the shotgun, police said. Hairston also said he put the stolen items in the dryer at the Walnut Street building and the three men hid in a third-floor apartment. Stitchel denied being involved in a robbery.

In addition to the robbery charge, the three men were charged with class B felony burglary, class C felony criminal threatening with a dangerous weapon and theft by unauthorized taking, a misdemeanor.

Stitchel also was charged with violating condition of release, a misdemeanor.
