SARAJEVO, Bosnia-Herzegovina (AP) – A Bosnian Serb war crimes suspect who was captured last month in a shootout that killed his wife and wounded his son was released from custody Friday.

Dragomir Abazovic, who was arrested Jan. 5 after a gunbattle with European Union peacekeepers, was charged two years ago with war crimes from the 1992-95 Bosnian war, during which he served in the Bosnian Serb army.

But Bosnia’s State Court ruled Thursday that Abazovic should be freed because that indictment was issued by a regional court before new laws transferred jurisdiction for all war crimes cases to the State Court.

Abazovic was released Friday from a hospital in Sarajevo where he was being treated under police guard for wounds he suffered during his arrest, hospital officials said.

His wife and 11-year-old son had opened fire on the peacekeepers to try to help him escape, and in the ensuing gunfight, the woman was killed and the boy was injured, authorities said.

Authorities said Abazovic shot himself in the head during the January gunbattle, but survived.

Abazovic’s case has been transferred to the new State Court, which is expected to issue a new indictment and arrest warrant.

The 6,500-strong EUFOR force is involved in searching for fugitive war crimes suspects and in combating organized crime throughout Bosnia. It took over from a NATO force in 2004.
