BERWICK (AP) – A Berwick couple has filed notice that they intend to sue the police department for arresting the wife last summer for allegedly possessing cocaine when the substance was actually a colon medication.

In the claim, the attorney for Lisa and Troy Chabot alleges that Capt. Jerry Locke acted with a “reckless disregard for the truth” by releasing information to the media about seizing cocaine and saying there was “some question” as to whether Troy Chabot was a felon.

In fact, the white powder that police said was cocaine turned out to be Lisa Chabot’s medication, Alfred Catalfo, who represents the couple, told Foster’s Daily Democrat. Troy Chabot, Catalfo added, is not a felon.

“She spent 10 days in jail and both have had their names dragged through the mud,” Catalfo said. “This is a very serious matter. “

Police issued a felony arrest warrant for Lisa Chabot in early August after evicting her from her home, which was being foreclosed upon. During the eviction, police said they found 70 grams of cocaine, weapons and drug paraphernalia.

After her arrest, Lisa Chabot spent 10 days in jail before the York County district attorney’s office dropped the charges.

Lisa Chabot is claiming defamation, wrongful arrest, false imprisonment, malicious prosecution, negligent and/or intentional infliction of emotional distress and violations of her state and federal constitutional rights, Catalfo said.

Troy Chabot is making the same claims, except for wrongful arrest and false imprisonment.

The couple is seeking damages in excess of $1 million.

Locke did not return a call seeking comment.
