BANGOR (AP) – A Lee man accused of fatally shooting his wife in the leg has been indicted on charges of depraved indifference murder and reckless or criminally negligent manslaughter.
The indictment Monday marked the second time that charges against Carl Dyer, 50, were upgraded in the shooting of his 52-year-old wife, Rosemarie.
The defendant was arrested on an aggravated assault charge July 2, two days before his wife died in Eastern Maine Medical Center. At his initial District Court appearance July 6, Dyer was charged with manslaughter in addition to elevated aggravated assault.
The Attorney General’s Office said Monday that Dyer’s charges had been upgraded again in Penobscot County Superior Court.
“We do this on occasion,” Maine Deputy Attorney General William Stokes said. “The difference between manslaughter and depraved indifference murder is a matter of degree, and it’s up to the jury or judge to decide what this qualifies as.”
No arraignment date was set.
If convicted of murder, Dyer faces 25 years to life in prison. He could face up to 40 years if convicted of manslaughter.
When taken into custody, Dyer told a police dispatcher that his wife angered him and he shot her inside the couple’s manufactured home on Ridge Road, a police affidavit said.
Police arrived to find Dyer in front of the home with blood on his hands and a shotgun broken into three pieces lying at his feet. Rosemarie Dyer was found inside lying on a couch with a pool of blood on the floor next to her, according to the affidavit.
Police said Dyer was a convicted felon who should not have been in possession of firearms.
Dyer was being held at the Penobscot County Jail in lieu of $50,000 bail. Stokes said that with the addition of a murder charge, the issue of bail will be reconsidered.
