PERU – The Peru Appeals Board met on Thursday night to review an appeal made by Paul Bickford on fines imposed on him by the Planning Board. The fines, approximately $16,800, were questioned by Bickford’s attorney, David Austin of Rumford.

Bickford’s concise statement requested a waiver from the fines imposed for alleged Shoreland Zoning violations. Appeals Board member Jim Pulsifer said, “I feel the application is incomplete because Mr. Bickford does not state what he is appealing and the reason why.”

Austin countered that the town should have supplied an application form that asked the proper questions. He also said they are wanting verification about who in the town of Peru can impose fines. He contended that only the courts can impose fines.

This statement brought a rebuttal from Code Enforcement Officer Mike Boyd, who said he had the authority of imposing fines as approved by the Board of Selectmen.

After swearing Bickford in, Austin went through a series of questions to his client which inferred that Bickford was not aware of any board meetings where the fines were discussed and, therefore, had not been properly notified.

Bickford received the permit in 2002 to start building. He was not cited in 2003 and 2004 for violations by the CEO. There was disagreement between the CEO and Bickford about whether Bickford had changed the setback, elevation of the building or altered the dwelling from a summer to a year-round residence.

Austin said it was unlawful for the Planning Board to impose fines, which, furthermore, and besides it was done behind his client’s back.

Boyd said the setback required by Shoreland Zoning was not adhered to.

Austin said he was pleased with the proceedings of the night and glad the Appeals Board was seeking legal advice.

The question of who actually can impose fines caused the meeting to be adjourned until the Board of Appeals can seek legal counsel.
