BOSTON (AP) – The Middlesex district attorney has decided for a second time not to charge state Sen. James Marzilli with assaulting a woman in April.

District Attorney Gerard Leone said Thursday there is no new evidence to change the decision he announced in May.

The woman had accused the senator of accosting her back in April. Leone investigated for five weeks but says there were “factual and legal deficiencies” that preventing him from bringing charges.

Leone continues to prosecute Marzilli on charges that he sexually harrassed four women on one June day in Lowell. He subsequently sought psychiatric treatment.

Marzilli also faces a civil suit involving the woman from April, as well as two others who also claim he accosted them in Arlington.
