NASHUA, N.H. (AP) – A 21-year-old man’s 4-year sentence for sexually assaulting a Hudson teenager won’t be changed, despite a state Supreme Court ruling that sent the case back to court for reconsideration.

Brandon Yates, of Nashua, was convicted of sexually assaulting the 14-year-old victim and leaving her unconscious in the woods behind Hudson Memorial School in November 2002.

In May, the high court sent the case back to superior court for resentencing. Yates had appealed and the Supreme Court said he couldn’t be held criminally responsible for leaving the girl because he had no legal duty to care for her.

But Yates ended up with the same sentence on the remaining convictions, felonious sexual assault and four counts of providing alcohol to minors.
