AUBURN – A superior court judge rejected murder defendant Todd Gamache’s motion for bail following a hearing Friday that offered insight into the injuries suffered by an 8-month-old girl Gamache was baby-sitting.

Justice Thomas Delahanty II, after listening to testimony from the hearing’s lone witness, Maine State Police Detective Scott Gosselin, denied bail for the 23-year-old Gamache, who remains incarcerated at the Androscoggin County jail.

Gamache told police he dropped the slippery baby in the bathtub and later on the living room floor in his final version of events surrounding the death of Emmy-Leigh Cole, Gosselin testified.

During the hearing in Androscoggin County Superior Court, Gosselin said Gamache provided police with three written statements during numerous interviews. He described his movements on March 22, the night his girlfriend’s baby was rushed to the emergency room with severe injuries. The baby died two days later when she was taken off life support. Gamache had been alone with the baby for about 45 minutes at his girlfriend’s Auburn home that night while she was at cheerleading practice. Gamache had moved into the woman’s home on Broad Street in December.

Gosselin said Gamache’s story kept changing as he added details each time. Gosselin told Gamache his story didn’t fit with what doctors had said about Cole’s injuries, as explained by a doctor who specialized in abuse cases and a state medical examiner.

During one of his final interviews with police, after he was indicted on a murder charge and arrested, Gamache said the little girl’s death was “a tragic accident.” He said he had given the baby a bath, but dropped her soapy, slippery body into the bathtub, where she hit her head. Later, as he carried her downstairs, Gamache tripped on something in the stairwell, he said during the interview. He spun around and the baby’s head struck the wall, Gosselin testified.

Downstairs, he put the baby on the living room floor in front of the television while he went into the kitchen to make himself a roast beef sandwich.

He heard a thud. When he came into the living room, the baby was lying on her side. He heard the cat scamper up the stairs. The baby had a bruise over her left eye and scratches on her cheek, Gamache told police during early interviews.

He said he picked up the baby and tried to comfort her. She bucked in his arms twice. He later told police the second time she resisted, Gamache dropped her on the carpet near the kitchen.

Gosselin said he asked a doctor to compare Gamache’s version of events to the injuries suffered by the girl according to medical records and autopsy results. The doctor told Gosselin he “did not believe (Gamache’s story) was consistent with his findings.”
