HYANNIS, Mass. – Peter Bennett, a Portland management attorney, will be speaking at the 23rd Annual National Workers’ Compensation and Occupational Medicine Seminar in Hyannis, Mass., July 22 to 24.
Bennett will address the nation’s leading workers compensation professionals, occupational physicians, occupational nurses and attorneys on the topic “Employee Disability Triggered Misconduct: What to Do and Not to Do.”
Bennett’s remarks will discuss the Americans with Disabilities Act, with emphasis on the provisions that impact an employer’s control over job performance, such as reasonable accommodation, undue hardship and the safety defense. He will distinguish on-duty versus off-duty misconduct and explain their legal ramifications, as well as offer practical suggestions on handling employee performance issues to minimize the potential for liability.
Bennett served as counsel to Lepage Bakeries Inc. in Reed v. Lepage Bakeries Inc., the leading case in the nation on this subject.
Bennett is president of The Bennett Law Firm, a Portland firm that specializes in representing management throughout the Northeast on matters of labor and employment law.
