The public will not be able to see the report until at least the city council has seen it.

AUBURN – A report on police handling of Mayor Norm Guay’s Aug. 4 drunken driving arrest is in, but the public will have to wait to see it.

City Manager Pat Finnigan said she received the report by Portland law firm McCloskey, Mina and Cunniff on Wednesday.

“But I haven’t had a chance to read it myself,” Finnigan said. “I won’t release it to the press at least until I present it to the council.”

Councilors are not scheduled to meet again until Nov. 17, Finnigan said.

“There has been some interest in the results of this report, so we may not decide to wait until the next scheduled meeting,” Finnigan said. “But first, I have to go through it and understand what it says.”

Guay admitted he drank a couple of beers the night of Aug. 4. Auburn police stopped Guay later that evening on East Hardscrabble Road for having an expired registration. Officers asked him to take a field sobriety test and then brought him to the Auburn Police Station to perform a Breathalyzer test.

Below the limit

That test showed the mayor’s blood alcohol content at 0.01, which is well below the 0.08 legal limit for operating a motor vehicle under the influence of alcohol.

The state Attorney General’s Office decided not to press charges later in August.

The city has been in labor negotiations with the police labor union since July, and Finnigan hired the Portland law firm later that week to review police reports and records.

Finnigan said the final report is about 80 pages long.

“It’s very thick,” she said. “They interviewed several people during the course of this investigation and were very thorough. Because of that, I’m not in a position to talk about it yet.”
