FARMINGTON – A Franklin County grand jury indicted Timothy D. Witham of Wilton on a manslaughter charge Wednesday in the death of a Farmington woman.

Witham was driving a Ford Taurus station wagon on Temple Road on March 15 when he lost control and hit a snowbank, flipping the vehicle onto its roof. Mary McDonald, 21, was sitting in the front seat when the accident occurred and died at the scene. She had been sitting in the center of the front seat wearing only a lap belt, according to assistant district attorney James Andrews.

The indictment stated that Witham “did recklessly, or with criminal negligence, cause the death of Mary McDonald.”

Witham, 18, flipped the vehicle and struck a tree that righted the car again. Witham sustained head and chest injuries and was hospitalized.

The other two passengers were treated and released from the hospital that day.

Witham will most likely appear in Superior Court when it next reconvenes on July 16.
