KITTERY (AP) – A Portsmouth, N.H., man accused of causing an explosion by crashing his pickup truck into a gasoline pump is challenging the case against him in Maine court.

In October, a New Hampshire judge reversed a drunken-driving conviction related to the March 28 crash in Kittery, ruling that Portsmouth police officers did not have probable cause to arrest John Harrington in New Hampshire.

In Maine, a York County grand jury indicted Harrington, 32, on charges of reckless conduct, operating under the influence and leaving the scene of a crime.

If convicted he would face a minimum five years in prison and up to $5,000 in fines.

The Maine court must determine whether the New Hampshire ruling affects the Maine proceedings.
