FALL RIVER, Mass. (AP) – Prosecutors said Monday they will not file charges in the death of a 1-year-old New Bedford girl who died after her mother left her in a parked sport utility vehicle for hours.

Brianna Correa was left in the SUV for much of the day on Sept. 28 until she was found around 4 p.m. by her mother, Marie Heylinger.

Bristol District Attorney Paul Walsh said Heylinger’s boyfriend, Raul Padua, forgot to drop the baby off at day care after dropping Heylinger’s two older children at school. Heylinger then took the car to work, but did not notice the baby sleeping in the rear-facing car seat.

Walsh said although the actions of Padua or Heylinger may be considered negligent, they do not rise to the level of criminal conduct.

He said the investigation into the baby’s death is now closed.
