RUTLAND, Vt. (AP) – A group of landowners around Lake Bomoseen is suing the state for a second time over increased restrictions on land along the shore.
The Lake Bomoseen Association filed their lawsuit three months after the Vermont Supreme Court denied the group’s original appeal of a 2003 Water Resources Board decision to upgrade 450 acres of wetlands from Class II to class I.
“Such alleged reclassification interferes with the legal rights or privileges of the individual plaintiffs,” said the new complaint, which would void the Class I designation.
The new lawsuit objects to the methods used by the Water Resources Board to change the classification.
It says the board did not follow the requirements of the Administrative Procedures Act.
The property owners want the court to overturn the reclassification ruling.
The Supreme Court ruled the reclassification was not subject to the courts.
