WILTON – Planning Board members continued the process of slogging through a permit application for a five-lot subdivision proposed for Village View Street on Thursday, according to Code Enforcement Officer Paul Montague.

“We’re still going through the general standards, but we’re not done by any stretch of the imagination,” he said Friday.

Of most concern is possible soil erosion and runoff from the steep embankment behind the former Forster Manufacturing facility on which homes would be constructed. Adam Mack, the landowner, does not plan to develop the property but rather sell individual parcels for home construction.

Planners were concerned about how erosion controls would be adhered to after the lots are sold and people begin to build on them, he said. They have requested a covenant be added to each deed to detail soil erosion plans and that these covenants are a condition of the permit.

There was also discussion about the town’s subdivision ordinance that requires developers to provide necessary infrastructure. However since Mack is not building on the lots but simply subdividing them to sell, it is unclear if planners need to operate by the same standards, according to Montague.

For example, another issue is an ordinance that would require the developer to provide a road into the subdivision. If a road is not provided, there would potentially be five new driveways leading into Village View Street. Board members, in an attempt to mitigate possible traffic concerns, considered suggesting three shared drives to the applicant.

“It’s not the standard concept of what a subdivision is,” Montague said. “It’s unusual in that respect.”

He said he is optimistic that the board will be able to issue a written finding of fact after their next meeting scheduled for 7 p.m. on Nov. 17.
