LEWISTON – Murder suspect Daniel Roberts of Sabattus will remain jailed this weekend after a bail hearing Friday was continued to next week.
Roberts, 35, said he was acting in self-defense when he shot his 29-year-old ex-girlfriend, Melissa Mendoza, on Aug. 15 at his home.
He told police Mendoza came to his house in the early morning and threatened to shoot him, their daughter and herself and flashed the .38-caliber revolver she stole from his closet.
The child was at the center of a bitter custody dispute between the two.
Mendoza was shot in the back of the head from a distance of two feet with a .38-caliber revolver Roberts had in his back pocket.
Investigators said they have been unable to lift fingerprints from the gun Roberts said she was using.
At the bail hearing, which began this week, more than one hour of a three-hour interview taped by state police investigators was played for Justice Joyce Wheeler on Thursday afternoon in District Court.
Wheeler is presiding over a hearing to determine if Roberts, who was arrested last week, should be allowed to be released on bail.
His attorney, Leonard Sharon, says he should.
“He’s no flight risk. He has no violent history, no convictions,” Sharon said.
Roberts has remained at the Androscoggin County Jail in Auburn since he was arrested earlier this month. 8th District Court officials expect the hearing to resume Monday and last until the middle of the week.
