MANCHESTER, N.H. (AP) – The former captain of the Saint Anselm College football team will spend 90 days in jail if a judge accepts his plea agreement in a BB-gun shooting.

Derek DiMartino, 24, of Bedford, filed papers in Hillsborough County Superior Court indicating he would plead guilty to both felony and misdemeanor reckless-conduct charges.

He would be sentenced to 90 days in jail but recommended for work-release. He also would be fined $1,000 and ordered to pay restitution.

DiMartino is charged with shooting BBs at three skateboarders at Saint Anselm in April. The boys, who were 15 and 16, were checked at a hospital and released.

The college expelled DiMartino, who is to enter the plea and be sentenced on Jan. 12.

DiMartino originally was charged with reckless conduct, second-degree assault, witness-tampering, conspiring to falsify evidence and possessing a controlled drug, Pregnyl.

A teammate who allegedly helped DiMartino get rid of the gun pleaded guilty in June to obstructing government administration, a misdemeanor. He was given a suspended jail sentence, fined $2,000 and ordered to do community service.
