PORTLAND (AP) – The state’s highest court on Tuesday upheld the convictions of a man who attacked a doctor when she interrupted a burglary in Fryeburg.
The Maine Supreme Judicial Court dismissed David Mair’s appeal of his aggravated assault and burglary convictions. In October, the court upheld his 18-year sentence.
Dr. Mary Nash identified Mair as her attacker, testifying that when she tried to call police he hit her several times, apparently with a flashlight, his hands and a wrench. She said he also brandished a knife and threatened to kill her.
Mair testified that he was in Fryeburg in September 2004 when Nash was attacked, but he claimed he had nothing to do with the crime.
Nash suffered a broken nose, two shattered fingers and cuts and bruises. She escaped by fleeing to a neighbor’s house.
