AUBURN – The attorney for a teenage boy charged with manslaughter in connection with a fatal crash last year is seeking to keep out of the youth’s trial statements he made to a hospital doctor.
Leonard Sharon, an Auburn lawyer, filed several motions in Lewiston’s 8th District Court for defendant Kyle Karkos, 18, of Auburn.
In his motion, Sharon wrote that after the April crash, Karkos was taken to a local hospital, where he was “heavily medicated and treated for serious injuries.”
Sharon continued: “Various law enforcement personnel positioned themselves in an area where, without the defendant’s knowledge and consent, they overheard his privileged communications to his physician.”
Such “violation and intrusion” into Karkos’ privacy mean the statements shouldn’t be allowed at trial, Sharon wrote.
A hearing on that motion is scheduled for June 18. A trial is expected to be held in late summer, Sharon said.
Sharon also was seeking access to the “rough notes” of any investigative officers as well as a floppy disc containing photos, according to court documents. A judge granted those requests.
Because Karkos is being tried as a juvenile – he was 17 years old when the crash occurred – his trial will be held in district court. No jury trials are held in that court. The trial is expected to last two to three days.
Kenny Jellison Jr., 18, of Auburn was a passenger in the car Karkos was driving when it crashed on Canal Street near Lisbon Street. Jellison died at the scene. Police said Karkos was reportedly racing another car at the time.
Karkos was charged in December with manslaughter, reckless conduct and driving to endanger. All three counts are felonies.
If convicted, Karkos would serve a sentence at a juvenile facility only up to his 21st birthday because he was charged as a juvenile.
Karkos denied the charges at a court hearing in December.
