PARIS – The grandfather of a 9-year-old boy who accidentally shot himself last June was fined Wednesday on two charges related to the incident.
Charles Martin, 51, of 207 Swift River Road in Mexico was fined $1,000 in Oxford County Superior Court after pleading no contest to misdemeanor counts of endangering the welfare of a child and cultivating marijuana.
Martin is the grandfather of Tyler Richard, who accidentally shot himself in the chest after finding a .38-caliber Derringer, a small handgun, hidden under the couch cushions at Martin’s home. Richard was visiting Martin when the shooting occurred. Martin had left the boy unsupervised when he went to pick up food.
Richard, who ran outside after the accident, was picked up and taken to the hospital by Thomas Harrison of Mexico, who saw the boy while he was driving by the house. Richard has recovered from his injuries.
Police later confiscated the handgun, a muzzleloader and a shotgun from Martin’s home. They also discovered some marijuana plants, which Martin said he was growing for a medical condition.
Assistant District Attorney Joseph O’Connor called the case a “tragic incident” in which Martin did not intend to harm Richard but was deserving of charges.
“Certainly the state’s position is that Mr. Martin was criminally negligent,” O’Connor said.
Ron Hoffman, Martin’s defense attorney, said he was pleased with the outcome of the case. “I thought that was just,” Hoffman said. “There wasn’t any intent.”
Hoffman also said Jeff Richard, Tyler’s father, is filing a civil suit against Martin. The case had not been filed Wednesday in either the Oxford County Superior Court or Rumford District Court.
“I think right now they’re dealing with the insurance company,” Hoffman said.
Hoffman said any money awarded in a settlement of the civil suit will go into a trust fund, which Richard will be able to access when he turns 18.
