SKOWHEGAN (AP) – A judge ruled Wednesday that a Palmyra man was legally insane and not criminally responsible in the fatal shooting of his live-in girlfriend’s 13-year-old son outside his home.
Todd Curry, 40, was charged with murder for allegedly shooting Anthony Tucker multiple times in the head on Nov. 28, 2006.
He had pleaded not guilty by reason of mental disease or defect, and has been at the Riverview Psychiatric Center in Augusta undergoing evaluations for most of the past year.
At Wednesday’s hearing before Justice Joseph Jabar, two forensic psychologists said in the week leading up to the shooting Curry suffered from delusions and paranoia brought on by a severe case of bipolar disorder with psychotic features.
They testified that Curry thought he was saving the world from aliens, and that he believed that his neighbors, a biker gang, the Secret Service and aliens were out to get him.
His attorney, Janet Mills, said the shooting was the result of his psychotic condition.
“He had no reason to kill that boy, he loved that boy,” Mills said.
Curry has a long history of mental illness that apparently started after he suffered a serious head injury in a car accident in 1986. In court Wednesday, he apologized while sobbing.
“Anthony was the greatest kid in the world,” he said.
As part of a plea agreement, Curry was sent back to Riverview Psychiatric Center, where he will be held until the Department of Health and Human Service determines the best place for him.
