CONWAY, N.H. (AP) – Town officials say a local hotel is defying a court order by opening an indoor water park.

The town has refused to issue an occupancy permit for the $14 million Kahuna Laguna at the Red Jacket Mountain View Resort because a ventilation building was added after the site plan was approved.

On Wednesday, a judge granted the town’s request for a temporary restraining order, but Town Manger Earl Sires said the park opened anyway.

The town plans to file a motion for contempt against the resort when the court reopens on Tuesday.
