RUMFORD – A Rumford man who was hit by a car on Route 2 late Friday afternoon remained hospitalized in critical condition on Tuesday evening at Central Maine Medical Center in Lewiston, according to a nursing supervisor.

David Mitchell, 38, suffered head injuries in the 4:15 p.m. accident atop Falls Hill.

Police Cpl. Doug Maifeld said Mitchell’s condition has remained critical since he was airlifted from Rumford Hospital to CMMC. Maifeld calls daily.

Maifeld said no charges will be filed against the driver who struck Mitchell, David Povelite, 76, of Andover.

Povelite’s 1997 Jeep Cherokee, which was seized by police as routine in such serious injury accidents, has been released to Povelite following a vehicle autopsy.

Maifeld said that according to a witness another driver narrowly missed hitting Mitchell, who was trying to cross the road just before Povelite’s Jeep struck him.

Due to an oncoming car in the opposite lane, Povelite told Maifeld that he had nowhere to go to avoid hitting Mitchell, who suddenly appeared in front of him.

Because there were no skid marks in the 35-mph section, police have no way to determine Povelite’s speed.

The Andover man told police he was traveling 30 to 35 mph, which is consistent with driving habit information provided police by family members, Maifeld said.
