PORTLAND —The trial for a Lewiston man charged in federal court in August with selling stolen tractors on eBay was expected to start this week, but has been pushed back to January.
Lawyers were scheduled to pick a jury Monday morning in the case involving Matthew Theriault, 25. A clerk at U.S. District Court said the trial date was rescheduled.
Theriault had sought to separate two of the 13 federal charges against him at trial. He argued in court papers that two of the counts didn’t stem from the same actions and plans as the other counts and didn’t involve the same people. Through his attorney, he only planned to testify about one of the two counts, but not to the other charges.
A judge denied his motion.
A federal grand jury indicted Theriault on Aug. 5. He is accused of selling three stolen Kubota tractors on eBay in 2006. He faces six counts of wire fraud, among other charges.
