AUBURN — A Lisbon man charged with attempted murder after allegedly ramming a dump truck into two police cruisers is expected to undergo further mental evaluation later this month.

A trial is scheduled for January.

Bartolo Ford, 48, has undergone psychological evaluations at State Forensic Service by state-contracted examiners. His trial has been postponed several times.

A judge in Androscoggin County Superior Court ordered a so-called Stage III evaluation last month after Ford’s lawyer, Darrick Banda, filed a motion.

“Certain areas relative to defendant’s state of mind at the time of the events in question in this case were not fully explored … and require further development,” Banda wrote in court papers. Ford’s reaction to the presence of a sleep aid and other medications in his system at the time of the incident, along with a head injury, should be explored in the upcoming evaluation, Banda wrote.

Moreover, conclusions drawn by earlier examiners that appear to be, “in some respects,” contradictory, suggest the need for further evaluation, Banda wrote.

Also through his attorney, Ford filed a motion to suppress all statements, evidence, test results and witness statements about the events of Sept. 15, 2008, claiming they were obtained illegally and in violation of his constitutional rights.

Ford was indicted last year by an Androscoggin County grand jury on a dozen counts, including charges of aggravated attempted murder, aggravated criminal mischief, reckless conduct, eluding police, theft and receiving stolen property.

The attempted murder charge stems from what was described in court documents as Ford’s repeated ramming of a police cruiser, which forced the officer to scramble out.

The indictment says Ford “did intentionally attempt to cause the death of Officer Matthew Johnson by knowingly and intentionally ramming his vehicle into the police cruiser of Officer Johnson, head on, just after Officer Johnson was able to escape.”

Police said Ford was spotted driving a truck filled with concrete tiles and other items reportedly stolen from Superior Concrete Co. on Minot Avenue. When they tried to stop the truck, Ford refused to pull over and instead sped away to Hotel Road, police said.

During the chase, Ford allegedly rammed the dump truck he was driving into a police cruiser driven by Cpl. Kris Bouchard, who fired at the truck and hit Ford in the upper leg, police said.

The chase ended in Poland after Ford slammed the truck into two parked cars, police said. From there, Ford fled on foot.

Police searched nearby woods, aided by tracking dogs, before Ford gave himself up.

The Attorney General’s Office later reported the police shooting was legally justified.
