LIVERMORE — Town officials will be developing an application and permit fees for the newly adopted Special Amusement Ordinance over the next couple months.

Voters approved the ordinance on June 10 that will require establishments that are licensed to sell liquor to apply for a special amusement permit if there is going to be live music, dancing and entertainment. The ordinance also puts restrictions on where an establishment that wants to have entertainment may be located.

There are two establishments in the town that currently hold liquor licenses, the Carriage House Cafe and the Maple Lane Golf Course and restaurant. Both liquor licenses are scheduled to be renewed in mid to late November. The permits for special amusements will run concurrent with an applicant’s liquor license as stated in the ordinance, Administrative Assistant Kurt Schaub said.

The application form and a fee should be established by mid-August, he said.

The fee for the amusement permit is intended to cover the cost of the town’s administrative processing of the application, including advertising costs and time of the code enforcement officer for review and inspections, Schaub said.

Both establishments appear to be within the restricted area for being granted a special entertainment permit as being within 1,000 feet of residences.

However, no one has measured the distance between the structures, town Schaub said.

The only way to find out what would happen to an existing business to determine if the ordinance would prohibit it from getting a permit would be to submit an application, he said.

Michael Weaver, owner of Carriage House Cafe and his mother, Sylvia Lane, both said the establishment should be grandfathered because it already exists and live entertainment has been going on for a few years.

Initially, the business was approved by the Livermore Planning Board to be a restaurant, Schaub said.

However, Weaver said he has been putting entertainment on his state liquor license all along.
