LIVERMORE FALLS — The Board of Appeals on Tuesday denied a request to overturn approval of an application for a pet crematory on Brookside Avenue,  Code Enforcement Officer James Butler Jr. said Wednesday.

The Planning Board OK’d the site plan review application for Journey’s End crematory in October 2012.

Heather and Tarek Nadeau filed an administrative appeal, believing planners didn’t follow the town’s ordinance.

The appeals board decision was based on the Planning Board accepting the application as complete and waiving all other requirements, Butler said.

The decision can be appealed to Superior Court within 45 days, he said.

The appeals board postponed action on the appeal in December 2012 to get a legal opinion on the matter. It was determined that the Planning Board had followed the town’s ordinance when it approved the application from Michelle Pomeroy and Matthew Perkin, Butler said Jan. 4.

The application procedure in the ordinance allows that “any requirement may be modified or waived by the Planning Board.”

The couple plans to set up an incinerator in a detached garage at their home at 18 Brookside Ave.
