LIVERMORE FALLS — Residents voted 482-257 Tuesday to allow medical marijuana businesses in town.

The vote enacted an “Ordinance to Allow and Regulate Medical Marijuana Retail Stores, Cultivation Facilities and Product Manufacturing Facilities.” It outlines procedures and standards relating to the businesses.

Under the ordinance, a medical marijuana establishment must be 500 feet from the property line of a public or private prekindergarten-to-grade 12 school, or a day care center licensed by the state.

Proposed operating hours are 9 a.m. to 9 p.m.

If a medical marijuana cultivation facility, but not a medical marijuana caregiver retail store or a medical marijuana manufacturing facility, was legally in existence prior to the effective date of the ordinance, the same may not be expanded, changed, or otherwise augmented in any way without first receiving site plan approval from the Planning Board.

No medical marijuana establishments may operate within the town without first receiving a license from the Select Board. The licensee and establishment must also be in compliance with state and town rules.

No registered caregiver or other individual or entity may establish or otherwise begin to operate a medical marijuana establishment that was not legally operating prior to the adoption of the ordinance without first receiving site plan approval from the Planning Board.
