A Greenwood man is accused of driving a side-by-side utility vehicle under the influence of alcohol that, according to court documents, caused serious injuries related to a crash in Greenwood last August.

An Oxford County grand jury indicted Joseph F. Tracy, 44, on Feb. 11 on one count each of aggravated criminal OUI and operating an ATV under the influence, on Patch Mountain Road in Greenwood.

A conviction on each of the charges carries a maximum five years in prison and up to a $5,000 fine.

Tracy was driving an ATV on Aug. 2 on a downward grade when he went off the road to the right and struck a utility pole on the right-front passenger’s corner, where Dylan Feeney, 21, was seated.

The ATV spun sidways to the right and came to rest perpendicular to the road.

The passenger was ejected from the ATV and Tracy was partially ejected, according to a Maine Crash Report. The crash caused serious bodily injury to Feeney.

Both riders were injured, the report said. Neither was wearing a helmet.

According to a test, Tracy had a blood alcohol content of .15%, the court complaint said. The legal limit for driving a motor vehicle is anything less than .08%. 

Tracy was arrested on the charges on Feb. 17 and was released on personal recognizance bail the same day, an Oxford County corrections officer said.

He is scheduled to be arraigned on the charges on April 16 at Oxford County court.
