FARMINGTON — The trial of a Strong man facing a felony charge of burglary in the case of an armed robbery at the Big Apple in December 2010 was continued Wednesday till October.
Miguel Visuano, 27, was indicted in May 2011 on a felony charge of robbery. He is accused of going into the Big Apple on the Farmington Falls Road and robbing the store while wielding a small bat that had a chain attached to it, according to a Farmington police affidavit.
The trial was continued to June earlier this year and was set to begin Wednesday morning. With witnesses waiting to testify, Justice Michaela Murphy cleared the courtroom to talk with jurors.
After two alternate jury members were dismissed Tuesday, information about a communication held with one of the jurors surfaced.
“There was no misconduct,” Murphy said, adding it was one of those things that can happen in small towns.
Without the alternate members, one dismissed due to a death in the family and the other because they were a victim of a home burglary and didn’t think it would be fair, the number of jurors was limited to 11 instead of the the usual 12 for a trial.
The state prosecutor and Visuano’s attorney, George Hess, agreed to delay the trial due to the high stakes in this case, Murphy said.
Visuano remains in custody.
