PARIS – A judge denied a request Tuesday to amend the bail of one of seven people charged in the beating of a Massachusetts man in March.
Justice Robert Crowley made the decision in Oxford County Superior Court, ruling that Tyler D. Rogers, 21, of Andy Drive in Fryeburg, should remain in jail on $2,000 cash or $20,000 surety bail. Rogers is charged with kidnapping, aggravated assault and robbery.
Defense attorney Kelly McMorran said Rogers has been incarcerated since the bail was set on April 11, and that Maine Pretrial Services would be willing to establish a contract with him. McMorran said discovery materials show that Rogers did not play a significant role in the kidnapping of 21-year-old Philip M. Swanson of Malden, Mass., formerly of Norway. McMorran also said Rogers has no criminal history.
Assistant District Attorney Richard Beauchesne objected to the motion, saying pretrial services should be reserved for less serious offenses.
“Even though he doesn’t have a prior conviction, he certainly is starting at the top of the ladder,” Beauchesne said. “He was not at the top of the heap in terms of culpability. He’s not at the bottom, either.”
Rogers is accused of beating Swanson with his fists and a pistol after Swanson was driven to a Lovewell Pond Road residence on March 29. He was also accused of riding in a pickup truck that took Swanson to a dead-end road, where Swanson was further beaten and robbed.
According to police, Swanson was set up to be attacked after a botched drug deal in Malden, in which another man was robbed of $975 and Swanson was robbed of $60.
