PARIS – A South Paris man pleaded guilty Thursday to raping a 73-year-old woman who is mentally incapacitated.
Oxford County Superior Court Judge Thomas E. Humphrey sentenced Michael E. Horbovetz, 32, to eight years in jail with all but two years suspended. Horbovetz also received four years’ probation and is to have no contact with the victim.
Additionally, having been convicted of a sexually violent offense – gross sexual assault – Humphrey ordered Horbovetz to satisfy all requirements of the Sex Offender Registration and Notification Act, and to register for life as a sexually violent offender.
An Oxford County grand jury indicted Horbovetz on Nov. 19 on a charge of gross sexual assault, a Class B felony.
According to the indictment, Horbovetz, who was 31 at the time, was charged with engaging in a sexual act on July 23, 2004, with a woman who suffered from a mental disability, which made her incapable of appraising the nature of the contact involved, or understanding she had the right to deny or withdraw consent.
According to the incident report by the arresting officer, Norway Sgt. Rob Federico, Horbovetz had left Houston and moved to Norway, where the offense occurred.
