ST. JOHNSBURY, Vt. (AP) – A sheriff’s deputy has resigned after a Vermont State Police investigation into an underage drinking party at a home that occurred when he was upstairs.

Jeffrey Todd, 34, of Lyndon, a deputy with the Caledonia County Sheriff’s Department, was at the Burke home where the Nov. 22 party took place.

Todd told police he did not know the minors had alcohol. The owner of the home was apparently out of town at the time.

Eight minors were referred to a community diversion program on alcohol charges, but Caledonia County State’s Attorney Robert Butterfield found insufficient evidence to prosecute Todd for enabling them to consume alcohol.

Vermont State Police told Sheriff Michael Bergeron about the incident, and he began his own internal investigation into it. He determined that Todd – who was in the 15th week of a 16-week Vermont Police Academy training program – could not return to the academy while the investigation was ongoing.

Todd offered his resignation and Bergeron accepted it, Bergeron said.
