PARIS – The following people, all charged with felonies, appeared before Justice Robert E. Crowley in Oxford County Superior Court on Tuesday.
Justin Rolfe, 22, of 19 Edgerly Lane, Oxford, pleaded guilty to aggravated assault. He was indicted Oct. 5.
He was arrested Sept. 9 by Maine State Police at a party in Otisfield after causing “serious bodily injury” to another man. Two others, Tony Kimball and Peter Berube, were also charged, and their cases are pending.
The prosecution stated that the fight was unprovoked, and the victim is still recovering from injuries.
Rolfe is out on bail, and the case will be scheduled for sentencing in January. If convicted, Rolfe could face five years in prison, then spend four years on probation which, if violated, would send him back to prison for five years.
Keith Testani, 33, of Hanover was sentenced to one year in custody after violating his probation.
Testani previously served two years of a 13-year sentence after being convicted of gross sexual assault. After being charged with two counts of probation violation, he agreed to admit to one count if the other one was withdrawn.
Court records state that he was arrested on two counts of probation violation this summer for having contact with children under 16 and viewing pornographic materials. Testani has since been at the Oxford County Jail.
Crowley agreed to a stay of execution until Monday, so Testani could move out of his apartment.
Once he is released, in addition to other conditions of probation, he will not be allowed to use a computer unless it is in the context of employment.
Robby Brackett, 29, of 119 Reservoir Road, Paris, pleaded not guilty to charges of unlawful trafficking in scheduled drugs, escape and theft. He was indicted Oct. 5.
The charges originated May 20 when police say Brackett was arrested by Officer Dana Wessling of the Norway Police Department, put in handcuffs, searched and found to have $1,400 cash in his back pocket, then put in the cruiser. While the officer talked to another person at the scene, Brackett got out of the cruiser and ran into woods, the officer said in his report.
A small digital scale was recovered from the vehicle along with a bag of cocaine and a bag of marijuana.
Brackett is out on bail.
Tommy T. Paine Jr., 23, of 12 Turner Lane, Paris, pleaded not guilty to the charge of unlawful trafficking of scheduled drugs. He was indicted Aug. 21.
The charge comes from a July 30 incident. He was arrested after the Maine Drug Enforcement Agency found evidence that Paine had been trafficking cocaine.
Paine is out on bail.
Richard R. Austin, 45, of 678 Weld Road, Wilton, pleaded not guilty to two Class A counts of aggravated trafficking in scheduled drugs. He was indicted Oct. 5.
Austin was arrested by the Rumford Police Department, which stated that the incidents happened around March 9.
Police state that one of the drugs was cocaine, and the other was cocaine based. According to the indictment, the offenses occurred “on a school bus or within 1,000 feet of the real property comprising a… (school) or safe zone.”
Austin is out on bail.
