PORTLAND (AP) – Maine’s supreme court has upheld the conviction of a York County woman who along with her husband raped a 2-year-old girl and recorded the assault with a digital camera.
Tina Bickart contended the trial judge erred in allowing as evidence nude photos she and her husband had taken of themselves, as well as her husband’s testimony and palm print evidence.
Prosecutor Justina McGettigan contended the photos were necessary to show that Tina and Stephen Bickart liked to record sex acts, but Bickart contended they were prejudicial. The supreme court dismissed all of her arguments, but two justices dissented on the issue of the judge allowing the photographs.
Prosecutors said Tina Bickart brought the girl to her husband in their apartment in Sanford. She was ordered to serve 15 years for gross sexual assault. Stephen Bickart is serving 61/2 years in prison.
