PARIS – A 32-year-old Paris man pleaded guilty Thursday to demanding painkillers from a pharmacy clerk last fall.

Toby A. Boutilier of 51 Western Ave. entered a plea in Oxford County Superior Court to a charge of burglary.

Justice Andrew Horton accepted a plea agreement requiring Boutilier to serve nine months of a three-year prison sentence and three years of probation.

The plea dismissed a charge of attempted drug theft.

Assistant District Attorney Richard Beauchesne said Boutilier entered the Rite-Aid in Paris on Sept. 27 and demanded OxyContin from a clerk. He said Boutilier banged his fist and threatened to jump over the counter if the clerk didn’t comply.

Boutilier left the store after the clerk went to get a manager, and was arrested after he was found in a nearby vehicle.

Boutilier disputed that he made the threat or hit his fist on the counter, but said he did point to the counter and demand the drugs. He agreed with Horton that a clerk could have found the demand threatening.

“I wasn’t trying to be threatening,” Boutilier said. “I was in a really desperate need. I had a problem.”

Defense attorney Sarah Glynn said Boutilier has been in jail for a month after testing positive for drug use.

Horton allowed Boutilier a few days of release with house arrest conditions to get family affairs in order prior to beginning his sentence.

“Drugs are behind me,” Boutilier said. “I want to get this over with.”
