ALBANY, N.Y. (AP) – A video game called “Moxie Mania” can continue to operate in upstate New York bars.

A state Supreme Court judge in Albany struck down a Nov. 20 state Liquor Authority ruling that the slot-like game machines were illegal gambling devices. The game’s owner, Pace-O-Matic, challenged that ruling. The company says Moxie Mania is a game of skill, not chance.

The games were allowed to continue operating while the case was pending.

Players put money in the touch-screen machines to play a game that requires them to quickly solve a puzzle with numbers in a grid. Winners get cash payouts.

A similar Pace-O-Matic game was banned last year in Ohio.

Liquor Authority spokesman William Crowley says the agency will consider whether to appeal the court decision.
