LEWISTON – Police on Monday were still investigating a weekend shooting in which a 24-year-old local man was shot in the head and killed.
No charges were filed in the Saturday morning death of 24-year-old Shawn Fitzsimmons of Lisbon Road. Maine State Police detectives were gathering evidence to share with the attorney general’s office, according to state police spokesman Stephen McCausland.
Investigators have described the shooting as accidental, saying Fitzsimmons was in an apartment at 17 Horton St. with three friends who were passing around a 9 mm handgun.
The handgun is believed to be owned by 21-year-old Aryne Brown, who lives in the second-floor apartment where the shooting occurred. But investigators say it was 19-year-old Brandon Knight who pulled the trigger, firing a round that struck Fitzsimmons in the head.
Fitzsimmons was taken to Central Maine Medical Center, where he later died. Brown, Knight and 16-year-old Joseph Chase were questioned about the shooting and later released.
Investigators believe the three men and one teenager were drinking before Fitzsimmons was shot at about 2:30 a.m.
Lewiston police detectives initially began an investigation, and patrol officers responded to reports of a gunshot. However, because the shooting involved a fatality, Maine State Police were notified and ultimately took over the case. In Maine, state police investigate all homicides except in Bangor and Portland.
Police said they believe the shooting was accidental. However, they plan on consulting with the attorney general’s office to determine if charges should be filed. In a case of accidental homicide, charges from manslaughter to reckless conduct could result.
By Maine law, the charge of manslaughter applies when a negligent or reckless act leads to death. Reckless conduct is defined as a person who creates a substantial risk of serious, bodily harm.
The weekend shooting marked the second homicide in Lewiston in less than a week. Neither has resulted in an arrest.
Last Sunday, Sept. 4, 32-year-old Jamilah Shabazz died after he was stabbed in the chest in a Knox Street apartment. Police believe Shabazz’s girlfriend, 31-year-old Tarina Botelho, was involved in the knifing.
Detectives interviewed Botelho shortly after the late night stabbing and are now trying to determine if Shabazz’s death was the result of an accident or self-defense.
Maine State Police also took over the investigation of that homicide. McCausland said the results of the probe will be reviewed by the attorney general’s office as well.
Botelho is believed to have left the state.
