LIVERMORE – Another landowner on Long Pond is disputing the fairness of the fine for alleged violations of the Shoreland Zoning Ordinance.

Michael Saucier met with the Board of Selectpersons last week to voice his objections to a $750 fine levied on him by Code Enforcement Officer Richard Marble.

Marble was unable to attend the hearing so the board listened to Saucier’s explanation of the situation in the Western Shores subdivision where he is accused of building a road to the shore.

Saucier told the board he did not build the 14-foot road in question, that it was there, all around his property when he purchased it, apparently having been done by a skidder. He said he purchased the property from Kurt Youland.

Since he couldn’t access his property from the loop, he said he did put in a driveway for which he received a permit from alternate CEO Doug Marble, who was substituting for his father at the time.

He then was told he was in violation, sent a consent agreement and notified of the fine but was unable to find out from the senior Marble the reason for the fine.

Apparently, Saucier put in the driveway to his property without a permit and Selectperson Brenda Merrill told him about the town’s policy that has the owner purchasing a driveway culvert and the town installing it.

Road Foreman Bert Bryant, backed by Selectperson Tom Berry, said the 12-foot pipe would be too big and a culvert wouldn’t serve any purpose as there is no problem.

Administrator Kurt Schaub explained that the town is aggressive in the protection of its shoreland and that the fine probably is a matter of consistency.

Other landowners in Western Shores, Lisa and Timothy Chouinard, attended the Nov. 8 board meeting, questioning their $250 fine for alleged violations that included chipping brush that was laid in the shoreland zone and having a fire ring. Both incidents have been tabled until Marble can be present and, in the Chouinard case, until a state inspection is made.
