KENNBUNKPORT (AP) — The town of Kennebunkport is asking the Maine Supreme Judicial Court to reconsider its ruling vacating the right to public access to Goose Rocks Beach.

The York County Coast Star (http://bit.ly/1hwcM4S) reported that the town says the decision makes it unclear if previous rulings that sided with public access are automatically overturned. The town wants the case to be sent back to a Superior Court judge to rule access rights on a case-by-case basis.

Such appeals are rare.

In this case, a Superior Court judge upheld the public’s right to use Goose Rocks Beach, saying the public established that right by its longtime use. But the supreme court ruled that property owners along the beach have a say over who gets to use the beach to the low-water mark.
